What Information We Collect and How We Collect It

Some of the information we collect is Personally Identifiable Information (“PII”). We need to collect some information when you submit a request to demo the Factly Platform, subscribe to any of our newsletters, or make inquiries through our Website (including engaging the chatbot) or via email. You may provide your business contact information for any of these activities.  However, if you choose to provide personal contact information instead, the following PII will be collected with your consent: first and last name, email address, phone number and any other information that you provide to us that is linked to your identity. We will only ask you for PII that is relevant to the services that we provide and the maintenance of the Website. Remember that you always have the option not to provide this information by choosing not to use the Website or by not using the particular feature of the Website from which the information is being collected.

We also collect information through the use of “cookies” or other similar technologies. “Cookies” are alphanumeric identifiers in the form of text files that are inserted and stored by your web browser on your hard drive or via mobile IDs. Factly may set and access cookies on your computer or mobile device to track and store preferential information about you, for purposes such as recognizing you when you return to the Website, or collecting analytics data for our internal use, etc. 

We also automatically collect the IP address of the device used to access our website.

If you access our Website through the use of a mobile device, we may also collect and store  unique device identifiers, such as mobile IDs. Unique device identifiers are small data files stored on or associated with your mobile device which uniquely identify said device.  A unique device identifier may send us information about how you access, browse and use the Website. This information is aggregated and compiled to enable statistical analysis of our services that would be used internally to make improvements to our Website. 

We may collect non-personally identifying information that relates to your Website usage or is necessary for the proper functioning of the Website, such as the time and date and the extent of your usage of the Website, which pages of the Website you visit and for how long, the mobile platform or service provider you use, your browser, your operating system, and IP address (“Other Information”). We aggregate and compile this data to enable statistical analysis of our services that would be used internally to make improvements to our Website. If we ever associate Other Information with you as a specific and identifiable person, we treat it as PII.

Information collected by us may be stored and processed in Canada or the United States. As of the date above, the Website is hosted on facilities operated in the United States. By using the Website and checking the boxes where indicated, you consent to any such transfer of information outside of your country, where data protection laws may be different. Factly makes no representation or warranty with respect to any duty to permanently store any information you may provide. Our Use of Information

We use the information we collect for a number of purposes. For example, we will use it to, among other things, enforce the Website Terms of Use, respond to your inquiries and otherwise correspond with you, maintain the security and integrity of our Website and services, and for the administration, review and/or improvement of the content of our Website and services. If you have agreed to receive such notifications, we will use your information to communicate with you about services that we think may interest you. We may aggregate your information for market research, project planning, troubleshooting problems, and detecting and protecting against error or fraud, or as otherwise described to you at the time of collection.

You agree that Factly may use information collected about you to analyze Website usage, improve the Website, respond to your requests, questions and comments, and as otherwise set forth in this Privacy Notice, or as Factly believes necessary to protect its rights and the rights of others, including by enforcing the Website Terms of Use. 

Factly maintains a strict “no-spam” policy. You may sign up to receive our newsletter, notices and/or special offers via email. If you agree to receive such information, Factly may use your information to contact you about services or convey information that we think may interest you (such as administrative notices, or newsletters) or deliver information to you that is relevant to your use of the Website.  We will: (i) identify the message as an advertisement in a reasonable way; (ii) honor opt-out/unsubscribe requests quickly; and (iii) allow users to unsubscribe by using the link at the bottom of each email. We will not use false or misleading subjects or email addresses.

Disclosure/Sharing of Information

We do not share your PII with any third parties, except to provide you with services connected to this Website, such as chat or email. We would disclose to such third parties (who would be required by us to comply with this Privacy Notice and any other obligation we have with respect to any information provided by you in connection with the Website, to the same extent as our obligations) the PII necessary for such third parties to provide such services.

We do not sell your PII.  Such information is used only within Factly’s internal organization and is not sold to third parties, including third party advertisers.

In the event that Factly is acquired by or merged with a third party entity, or sells all or substantially all of its assets, we reserve the right, in any of these circumstances, to transfer or assign the information and content we have received and collected from our users as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, we may not be able to control how your PII is treated, transferred, or used.

How We Protect Your Information

Factly takes a range of security measures designed to protect your information and keep it confidential and free from any modification or alteration unless authorized by you. PII is contained behind secured networks and is only accessible by a limited number of persons who are required to keep the information confidential. In addition, all PII you supply is encrypted.

However, the Internet by its nature is not a secure environment and the nature of security risks is constantly evolving, as are the technical and organizational industry standards relating to management of those risks. While we strive to keep current our security technology and will review, refine and upgrade our security technology as we deem appropriate based on new tools that may become available in the future, the complete security of any information collected, stored or used by us cannot therefore be guaranteed. In the unlikely event that an unauthorized third party compromises Factly’s security measures, Factly will not be responsible for any damages directly or indirectly caused by an unauthorized third party’s ability to view, use or disseminate such information. 

You hereby acknowledge that Factly shall not be responsible or liable for any dissemination of your information that results from your disclosure of such information to any third party.

Retaining Your Information

We will retain any information submitted to, or collected via, the Website for a commercially reasonable period of time necessary for the purposes outlined in this Privacy Notice.

Managing Your Information

Children’s Privacy

The privacy of children is of the utmost importance, and we are committed to complying with the Children’s Online Privacy Protection Act (COPPA). This Website does not knowingly use, disclose or accept submission of PII from children under the age of 13. If we ever discover that PII from children under the age of 13 has been inadvertently submitted to the Website, we will delete it as soon as possible.
